Terms of service

VSUL runs in your browser. Your audio and your images are decoded on your own machine and are never sent to us. You keep every right in what you make. In exchange you confirm you have the right to use the material you feed it, and you accept that we cannot promise a browser-based renderer will behave identically on every device.

WHO WE ARE

WHAT THE SERVICE IS

VSUL is a generative video tool that runs entirely inside your web browser. It reads audio and images you choose, renders frames on your device, and writes a video or image file to your device. It is not a hosting service, a social network, or a distribution platform.

LOCAL PROCESSING

Audio files, photos, videos and microphone input you use in VSUL are processed on your device and are not transmitted to our servers. Your projects and saved stacks are stored in your browser's local storage. This is a design commitment, not an incidental fact — if it ever changes, we will say so before it does, in this document and in the product.

YOUR MATERIAL, AND YOUR PROMISE ABOUT IT

You keep all rights in the audio, images and video you bring, and in the work you produce with VSUL. We claim no licence over any of it.

In return, you confirm that you own or are licensed to use every piece of material you put into VSUL, and that your use of the output does not infringe anyone's copyright, trade mark, publicity or privacy rights. You are solely responsible for what you make and where you publish it. If a claim is brought against us because of material you used, you agree to indemnify us for it.

Plainly: using a track you do not have rights to may infringe the rights of whoever does, and platforms you upload to may remove or monetise your video. That is between you, the rights holder and that platform.

TEMPLATES AND SHARED STACKS

Templates published by VSUL are licensed to you for any use, commercial included, while your account is in good standing. You may not resell or redistribute them as a preset pack.

If we ever let users publish templates, a published template carries a stack and a preview image. By publishing you grant us a non-exclusive licence to host and display those, you confirm you hold the rights to any imagery in the preview, and you accept that we may withdraw a template at our discretion.

ACCOUNTS AND PLANS

You need an account for a paid plan. Keep your credentials to yourself; you are responsible for activity under your account. One account is for one person. Free accounts render at reduced resolution and duration with a watermark; Pro removes those limits. Current limits and prices are shown in the product and may change with notice for future billing periods.

WHAT YOU MAY NOT DO

Do not use VSUL to make material that is unlawful where you are; to infringe rights you do not hold; to create sexual content involving minors or non-consensual sexual imagery of any real person; to impersonate a real person deceptively; or to produce imagery designed to trigger photosensitive seizures. Do not attempt to bypass plan limits, resell access, or scrape the service. We may suspend an account that does.

STROBE AND PHOTOSENSITIVITY

VSUL can produce rapid flashing and high-contrast strobing. A small number of people may experience seizures from such imagery. You are responsible for warning your audience where the output is shown publicly, and for complying with any venue or broadcast requirements that apply.

NO WARRANTY ON A BROWSER RENDERER

The service is provided "as is". Because VSUL renders on your hardware through your browser, frame rate, export support and visual output vary by device, operating system and browser version. We do not warrant that any particular export format, resolution or frame rate will be available to you, that the service will be uninterrupted, or that a render will be free of artefacts. Live performance use is at your own risk — always have a fallback.

LOSS OF WORK

Projects are stored in your browser. Clearing site data, browsing privately, or switching device or browser will lose them. We are not able to recover them. Export anything you care about.

LIABILITY

To the extent the law allows, we are not liable for indirect or consequential loss, lost profit, lost work, or losses arising from a failed render or performance. Our total liability is capped at the greater of the fees you paid us in the twelve months before the claim, or [AMOUNT]. Nothing here limits liability that cannot lawfully be limited, and consumer rights you have under local law are unaffected.

CHANGES, TERMINATION, LAW

We may change these terms; material changes get notice by email or in-product before they take effect for a new billing period. You may stop using VSUL at any time. We may suspend or close an account for a breach of these terms. These terms are governed by the law of [JURISDICTION], and disputes go to the courts of [JURISDICTION].

Privacy policy

We hold your email, your plan, and payment records kept by Stripe. We do not hold your music, your images, your microphone audio or your projects — those stay on your device. We do not sell personal information and we do not use your material to train anything.

WHAT WE COLLECT

Account: email address, and artist name if you give one. Legal basis: performance of the contract.

Billing: plan, billing cycle, renewal date, and the payment records our processor keeps. We never see or store your full card number. Legal basis: contract and legal obligation.

Technical: IP address, browser and device type, and error reports, kept to run and secure the service. Legal basis: legitimate interests.

Product analytics, if enabled: aggregate counts of features used and exports completed, without your media. Legal basis: consent where consent is required.

WHAT WE DO NOT COLLECT

We do not receive the audio files you load, the photos or videos you add, your microphone input, or the projects you build. All of that is processed on your device and stored in your browser. We do not use any of it to train models. We do not sell or share personal information for cross-context behavioural advertising.

MICROPHONE

If you choose microphone input, your browser asks permission and the audio is analysed live on your device to drive the visuals. It is not recorded, stored or transmitted. Revoke the permission in your browser at any time. The same applies to camera input.

LOCAL STORAGE, NOT TRACKING COOKIES

VSUL uses your browser's local storage to keep your session, your stacks and your settings on your device. It is functional, not advertising. Clearing site data removes it, and removes your saved projects with it.

PROCESSORS WE USE

Payments: [STRIPE / OTHER] — email and billing data. Authentication and database: [PROVIDER] — email, plan. Email delivery: [PROVIDER] — email address. Hosting: [PROVIDER] — server logs. Fonts are served by [SELF-HOSTED / GOOGLE FONTS], which may receive your IP address. Each is bound by a data processing agreement, and international transfers rely on Standard Contractual Clauses where applicable.

HOW LONG WE KEEP IT

Account data for as long as your account exists, then up to 90 days. Invoices and tax records for [7] years, as the law requires. Server logs for [30] days. Analytics in aggregate, indefinitely, with no identifier attached.

YOUR RIGHTS

You can ask for a copy of your data, correct it, delete it, restrict or object to processing, or take it elsewhere. Write to privacy@vsul.app and we will answer within 30 days. If you are in the EEA or UK you may complain to your supervisory authority. If you are in California you have rights to know, delete, correct and opt out of sale or sharing — we do not sell or share, so there is nothing to opt out of, and we will not discriminate against you for exercising any right.

CHILDREN, SECURITY, CHANGES

VSUL is not for under-16s and we do not knowingly collect their data. We use encryption in transit, hashed credentials and least-privilege access; no system is perfectly secure, and we will notify you and any regulator of a breach affecting you as required. We will post changes here and date them, and tell you by email if a change is material.

VSUL does not host your media. Audio and images are processed on your device and never reach our servers, so there is nothing on our systems to take down. Where we do host something — a published template and its preview image — this policy applies and we will act on a valid notice.

WHAT WE HOST, AND WHAT WE DO NOT

We do not host user audio, photographs, video or rendered exports. Those exist only on the user's own device. What we may host is: templates published through VSUL, including their preview images; blog and tutorial content we publish; and account records. A notice can only be actioned against material we actually host.

DESIGNATED AGENT

Send notices of claimed infringement to our designated agent:

WHAT A NOTICE MUST CONTAIN

To be effective under 17 U.S.C. § 512(c)(3), a notice must include: a physical or electronic signature; identification of the copyrighted work claimed to be infringed; identification of the material claimed to be infringing and enough information for us to locate it; your name, address, telephone number and email; a statement that you have a good faith belief the use is not authorised by the owner, its agent or the law; and a statement that the information is accurate and that you are authorised to act for the owner, made under penalty of perjury.

Knowingly filing a false notice can make you liable for damages, including costs and legal fees.

WHAT WE DO WITH ONE

We acknowledge within [2] business days. If the notice is valid and concerns material we host, we remove or disable access to it expeditiously, note it in our records, and tell the person who published it, passing on the notice. If the notice concerns material we do not host, we say so and explain where it actually lives.

COUNTER-NOTICE

If your material was removed and you believe that was a mistake or a misidentification, send a counter-notice to the same agent with: your signature; identification of the removed material and where it was; a statement under penalty of perjury that you have a good faith belief it was removed by mistake or misidentification; and your name, address, telephone number and consent to the jurisdiction of the federal court for your district, or [DISTRICT] if you are outside the United States. We forward it to the complainant and may restore the material in 10 to 14 business days unless they tell us they have filed a court action.

REPEAT INFRINGERS

We keep a record of notices per account. An account that accumulates [3] valid, uncontested notices is terminated. We reserve the right to terminate sooner for flagrant infringement. This policy is applied consistently and its records are retained.

Billing & refunds

Try the free tier before you pay — it renders real files. If you buy and it does not work on your machine, tell us within 14 days and we refund in full, no argument. Cancel any time and keep Pro until the period you paid for ends.

WHAT YOU PAY

Pro is charged monthly or yearly in advance, in [CURRENCY], at the price shown at checkout. Taxes are added where required. Payment is handled by [STRIPE], which stores your card details; we do not. Yearly is billed once for twelve months.

RENEWAL AND CANCELLATION

Subscriptions renew automatically until cancelled. Cancel from your account at any time; Pro continues to the end of the period you have already paid for, and you are not charged again. We email a reminder before a yearly renewal.

14-DAY REFUND

Ask within 14 days of your first payment and we refund it in full. No reason needed. Write to billing@vsul.app from your account email; refunds go back to the original payment method within [10] business days.

Because VSUL renders on your own hardware, performance and export support vary by device. That is exactly what the free tier is for — please confirm it works for you before buying. If it does not, this refund is unconditional.

AFTER 14 DAYS, AND RENEWALS

Monthly payments after the first are not refundable — cancel instead and keep the rest of the month. For a yearly plan cancelled early we refund the unused whole months on request. If a renewal charged you by surprise, tell us within 30 days and we will refund it.

EU AND UK WITHDRAWAL

Consumers in the EU and UK have a statutory 14-day right of withdrawal for digital services. Where you ask us to begin immediately and acknowledge losing that right, it may not apply — but our own 14-day refund above is offered regardless, so you are never worse off.

ARTIST GRANTS, PRICE CHANGES, CHARGEBACKS

Granted seats are free, discretionary and carry no refund right. If we change the price we tell you at least 30 days ahead and it applies from your next renewal, which you may cancel first. Please contact us before raising a chargeback — it costs us a fee and we would rather just refund you; accounts with an unresolved chargeback may be suspended.
